1. Eligibility:
This giveaway is open to legal residents of the United States who are 21 years of age or older at the time of entry. Employees of Whomp It Glass and their immediate family members are not eligible to participate. Void where prohibited by law.

2. Agreement to Rules:
By participating, you agree to be fully unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Whomp It Glass as final and binding as it relates to the content of this giveaway.

3. Giveaway Period:
The giveaway begins on 8/21/2024 and ends on 8/28/2024 at 11:59 PM PT (the "Giveaway Period"). Entries that are submitted before or after the Giveaway Period will be disqualified.

4. How to Enter:
To enter, participants must complete the following actions during the Giveaway Period:

• Like the official Whomp It Glass giveaway post on Instagram or Facebook.
• Comment on the giveaway post with their guess of the number of gumballs in the machine before it was broken.
• Subscribe to the Whomp It Glass email newsletter.

There is a limit of 1 entry per person. Multiple entries from the same person beyond this limit will be disqualified. Only one email submission per person is allowed. Using multiple email addresses to enter will result in disqualification.

5. Prizes:
The winner will receive a $1,000 shopping spree store credit for Whomp It Glass products, which will be sent via email after age verification. The products purchased with the store credit can only be shipped to the US. The specifics of the prize shall be solely determined by Whomp It Glass. No cash or other prize substitution shall be permitted except at Whomp It Glass's discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner.

6. Odds:
The odds of winning depend on the accuracy of the guess and the number of eligible entries received.

7. Winner Selection, Notification, and Age Verification:
The winner will be the first person to guess the correct number of gumballs in the machine, or the closest guess, who also completes all other entry requirements. In the event of a tie, the winner will be chosen by a random drawing among the tied entries.

The winner will be notified via direct message on Instagram or Facebook within five (5) days following the winner selection. The winner must complete an age verification process to confirm they are 21 years of age or older before any products are mailed. Failure to complete age verification will result in disqualification and selection of an alternate winner.

Whomp It Glass shall have no liability for a winner's failure to receive notices due to missed notifications, incorrect Instagram/Facebook settings, or for the winner's provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time the Instagram/Facebook notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited, and an alternate winner selected.

8. Rights Granted by You:
By entering this giveaway, you grant Whomp It Glass permission to use your name and likeness for promotional purposes in connection with the giveaway, without additional compensation.

9. Terms & Conditions:
Whomp It Glass reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the giveaway for any reason, including if a virus, bug, non-authorized human intervention, fraud, or other cause beyond Whomp It Glass’s control corrupt or affect the administration, security, fairness, or proper conduct of the giveaway. In such case, Whomp It Glass may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Whomp It Glass. Whomp It Glass reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the giveaway or website or violates these Terms & Conditions.

10. Limitation of Liability:
By entering, You agree to release and hold harmless Whomp It Glass and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the giveaway; (v) electronic or human error in the administration of the giveaway or the processing of entries.

THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Boca Raton, Florida having jurisdiction.
